Rules for using the kiran.pl informational website.

§ 1. General provisions
- These terms govern the use of the website available at https://kiran.pl (the "Site").
- The Site is operated by Kiran Sp. z o.o. with registered office in Pruszków (05-808), ul. Działkowa 95/10, Poland; registered in the Polish National Court Register under KRS 0000723560, Tax ID (NIP) 5342580173, REGON 369709340 (the "Operator").

§ 2. Definitions
- User - any natural person, legal entity or organisational unit using the Site.
- Content - all materials published by the Operator on the Site (texts, graphics, photos, audio/video).
- Services - services delivered by the Operator off-Site, including GDPR consulting and software development - provided under separate contracts.
§ 3. Scope and nature of the Site
- The Site is informational and marketing in nature. It presents the Operator's offering in GDPR compliance and business software development.
- Use of the Site is free of charge and does not require registration.
- Through the Site the Operator does not provide services within the meaning of Article 2(4) of the Polish Act of 18 July 2002 on the provision of electronic services other than:
- making information about the Operator and its offering available, and
- enabling the User to send an enquiry via the contact details published on the Site (email, phone).
- Commercial services (e.g. GDPR audit, application rollout) are provided under separate contracts entered into off-Site - their content is not regulated by these terms.
§ 4. Technical requirements
- Proper use of the Site requires a device with internet access, a current browser with JavaScript and cookie support.
- The Operator strives to keep the Site continuously available. However, the Operator does not guarantee uninterrupted availability and reserves the right to schedule maintenance windows.
§ 5. User rights and obligations
- The User uses the Site in accordance with the law, good practice and these terms. Supplying content of an unlawful nature is prohibited.
- In particular, Users may not undertake any action that compromises the integrity or security of the Site, including attacks, attempts at unauthorised access, automated scraping inconsistent with robots.txt, or publishing content that infringes third-party rights.
§ 6. Intellectual property
- Site Content, including trade marks, trade names, logos, product descriptions (esemeser.pl, enumenu.com, enuchat.com), photographs and graphics, is protected by copyright and industrial property law.
- Copying, modifying, distributing or commercially exploiting the Content without the Operator's prior written consent is prohibited. Accessing, browsing and printing or downloading materials for personal, non-commercial use is permitted.
§ 7. Liability
- Information on the Site is general in nature. It does not constitute legal, financial or other professional advice within the meaning of applicable regulations - specific cases require individual analysis by the Operator or other specialists.
- The Operator exercises due care to keep the Content current and accurate but accepts no liability for the consequences of decisions made solely on its basis, without prior consultation.
- The Site may contain links to external services (including esemeser.pl, enumenu.com, enuchat.com). The Operator is not liable for the content, operation or privacy practices of the sites those links lead to.
§ 8. Personal data and cookies
- The controller of Users' personal data is the Operator. Detailed processing rules are described in the Privacy policy.
- The rules for cookie use and the consent management mechanism are described in the Cookie policy.
§ 9. Complaints
- Complaints regarding the Site may be submitted by email to info@kiran.pl or in writing to the Operator's registered office.
- A complaint should include the complainant's identification details, a description of the issue and the requested resolution.
- The Operator considers complaints within 14 days of receipt. The reply is delivered using the same channel through which the complaint was filed.
§ 10. Final provisions
- Matters not covered by these terms are governed by Polish law, in particular the Act of 18 July 2002 on the provision of electronic services and the Civil Code.
- Disputes arising from the use of the Site are resolved by the court with jurisdiction over the Operator's registered office - except for disputes with consumers, to which the general jurisdiction rules apply.
- The Operator reserves the right to amend these terms. The current version is available at kiran.pl/en/terms together with the date of the last update.
